Vehicle liability damage that is partly covered

Information for policyholder

In our assessment, both drivers were partially at fault for the accident. The other party's damage will therefore be partly compensated by your mandatory vehicle insurance. Likewise, the other party's insurance company will partially compensate your damage.

Below we have compiled information about the next steps that we hope you will find useful.

Comprehensive insurance

If you have comprehensive insurance with VIS, it is easiest for you to use that insurance and then get a percentage of the deductible reimbursed by the other party's insurance company after the repairs. This is a simple way to settle the matter.

  • You simply send a copy of the repair bill to the other party's insurance company and request reimbursement of your deductible. Please note, however, that confirmation that the other company's conclusion is the same must have been provided before this is done.

  • If you did not inform us during the notification process that you wished to use your comprehensive insurance in the event that you were found at fault, please contact us.

  • If you informed us during the notification process that you wished to use your comprehensive insurance, you have already received an email or an SMS to confirm that comprehensive insurance is available. See further information.

If you do not have comprehensive insurance with VIS, we recommend that you contact the other party's insurance company regarding compensation for your damage.

Was anyone injured?

  • If the unfortunate event that you or others were injured in the collision, we would like to remind you that the accident must be reported separately.

Do you disagree?

  • If you disagree with our decision in the matter, you are welcome to contact us and receive a more detailed explanation.

  • Occasionally, the policyholder and VIS do not agree on whether or not damage should be compensated. If you are not satisfied with the decision on the assignment of fault, you will have the opportunity to refer the matter to the Claims Committee (Tjónanefnd) or the Appeals Committee for Insurance Matters (Úrskurðarnefnd í vátryggingamálum).

  • If you wish to submit the matter to the Claims Committee, please send us an email to tjon@vis.is as soon as possible. We will bring the matter before the Committee on your behalf. There you will have the opportunity to submit a more detailed statement in support of your case.

  • See further information about disputes.

Good luck!

VIS reserves the right to change a decision on the assignment of fault if new evidence is submitted or if committees or the courts come to a different conclusion on the assignment of fault.

Please note that if a driver causes damage by intent or gross negligence, for instance, if the driver was under the influence of drugs or alcohol or was guilty of dangerous driving or driving without a driver's license, the driver will be required to repay any compensation paid by an insurance company for the damage.
