Information for policyholder

Our assess­ment of the incident is that you were at fault. But don't worry!

Your mandatory vehicle insurance will cover the other party's damage and we will handle all further comm­unications regar­ding the matter.

Below we have compiled information about the next steps that we hope you will find useful.

For your information

The other party's damage will be assessed by an authorised workshop with a contract with VIS, if the other party requ­ests repairs to their vehicle. If the other party requ­ests negotiated compensation due to the damage, they will be instructed to take the vehicle to Smiðs­höfði 3-5, where VIS damage inspectors will assess the damage. Compensation will only be paid for damage that occurred in the incident in question.

Was your vehicle damaged in the accident?

If there is no comprehensive insurance, the damage to your vehicle is unfortuna­tely somet­hing you are responsible for. VIS does not compensate non-­insured damage.

If you have comprehensive insurance, VIS will compensate the damage to your vehicle accord­ingly.

  • If you did not inform us during the notification process that you wished to use your comprehensive insurance in the event that you were found at fault, please contact us.

  • If you informed us during the notification process that you wished to use your comprehensive insurance, you have already received an email or an SMS to confirm that comprehensive insurance is availa­ble. See further information.

Was anyone injured?

If the unfortunate event that you or others were injured in the coll­ision, we would like to remind you that the accident must be reported separa­tely.

Do you disa­gree?

  • If you disa­gree with our decision in the matter, you are welcome to contact us and receive a more detailed explanation.

  • Occasi­onally, the policyholder and VIS do not agree on whether or not damage should be compensa­ted. If you are not satis­fied with the decision on the assign­ment of fault, you will have the opport­unity to refer the matter to the Claims Comm­ittee (Tjóna­nefnd) or the Appeals Comm­ittee for Insurance Matters (Úrskurð­ar­nefnd í vátrygg­inga­mál­um).

  • If you wish to submit the matter to the Claims Comm­ittee, please send us an email to tjon@vis.is as soon as possi­ble. We will bring the matter before the Comm­ittee on your behalf. There you will have the opport­unity to submit a more detailed statement in support of your case.

VIS reserves the right to change a decision on the assign­ment of fault if new evidence is submitted or if comm­ittees or the courts come to a diff­erent conclusion on the assign­ment of fault.

Please note that if a driver causes damage by intent or gross negligence, for inst­ance, if the driver was under the influ­ence of drugs or alcohol or was guilty of dangerous driving or driving without a driver's license, the driver will be required to repay any compensation paid by an insurance company for the damage.
