Vehicle liability damage

Information on the handling of claims by another insurance company

In our assessment, you were not at fault and we believe that the other party's insurance company should compensate the damage to your vehicle. The damage should, therefore, not affect your insurance with VIS.

Below we have compiled information about the next steps that we hope you will find useful.

  • Since VIS has no involvement in the decisions of other insurance companies, we recommend that you contact the other party's insurance company and get confirmation that their conclusion is the same.

  • We have sent a copy of your claim notification to the relevant insurance company so they should have all the necessary information about the incident. They may need to hear from their policyholder before they can confirm liability in the matter.

  • Usually, insurance companies send e-mails to their claimants when a right to compensation has been established with information on the next steps regarding damage inspection and repairs. You can also find information about which workshops insurance companies are affiliated with on their websites.

  • If the vehicle is not drivable, it is best to let us know where the vehicle is located as soon as liability for compensation has been established. You should also be able to obtain information on whether payment for a rental car is available.

  • If the unfortunate event that you or others were injured in the collision, we would like to remind you that the accident must be reported separately. This is done through the website of the other party's insurance company.

  • If you want the damage to be paid out of your comprehensive insurance with VIS, that option is available. However, we would like to remind you that the comprehensive insurance has a deductible, which must be paid before any compensation. Please let us know if you wish to use that option and we will instruct you on how to proceed.

If the conclusion of the other party's insurance company is not the same as that of VIS, please contact us regarding how to proceed. In most cases, insurance companies reach the same conclusion, since traffic laws are used in determining assignment of fault for traffic accidents. Occasionally, however, insurance companies may disagree, in which case the matter needs to be brought before the Claims Committee (Tjónanefnd) or the Appeals Committee for Insurance Matters (Úrskurðarnefnd í vátryggingamálum).

Policyholders also have the right to submit a matter to the Claims Committee or the Appeals Committee if they disagree with an insurance company's decision. The parties will then have the opportunity to submit a more detailed statement in support of their case.

See further information about disputes.

Good luck!

VIS reserves the right to change a decision on the assignment of fault if new evidence is submitted or if committees or the courts come to a different conclusion on the assignment of fault.
